Legal T&Cs

  1. I enter into an agreement with Tiffani Eleanor Geraeds ABN 46 990 202 395 trading as Bump Baby Imaging (Bump Baby), to purchase the services which include but are not limited to a scan using ultrasound technology (the Scan) to produce 3D and 4D pregnancy imaging, printed and soft copy images, heart beat recordings and services relating to gender identification (collectively, the Services).

 

Bump Baby does not provide medical or diagnostic services

  1. I acknowledge and understand that Bump Baby does not provide any medical, clinical or diagnostic services.  I acknowledge and understand that Bump Baby is not equipped nor are the staff at Bump Baby trained or qualified to give any indication on the health or wellbeing of my baby or myself. 
  2. I understand that the Services I am purchasing from Bump Baby are for non-medical purposes only and the Services will only be keepsakes and mementos of my pregnancy.
  3. I acknowledge and understand that the Scan and the Services are not part of any prenatal care program and does not replace your Doctor’s medically requested scans.
  4. I understand that if Bump Baby notices something during the scan that requires my doctor’s attention they will contact my doctor and my doctor will proceed with any further investigations deemed necessary by my doctor.
  5. I understand that the scan will not be eligible for any Medicare or private healthcare rebate.

 

If I have any concerns I will immediately see my Doctor

  1. I am currently receiving prenatal care from a qualified Doctor or midwife.  This prenatal care will continue through out my pregnancy.
  2. Bump Baby has explained to me, and I understand, that the Services cannot in any way substitute for the care and advice of my Doctor or for the abovementioned prenatal care, this includes medical imaging services prescribed as part of the prenatal care.
  3. I have discussed the Services offered by Bump Baby and my election to undertake the Scan with my Doctor or midwife.  Further, I understand the advice that was given to me by my Doctor or midwife in relation to the Services and the pregnancy in general.  I understand that my Doctor or midwife has not ordered me to seek these Services.
  4. Should I have any concerns about my pregnancy or the health of my baby, whether these arose in relation to or in connection with the delivery of the Services I will immediately seek medical assistance from my Doctor, midwife or I shall attend a hospital emergency department.

 

No professional negligence claims

  1. I acknowledge and agree that I have no right to seek any recourse from Bump Baby with respect to medical malpractice, professional negligence or any medical related claim arising out of, under or in connection with the Services, Bump Baby or this agreement relating to my pregnancy or the birth and health of my child.
  2. I acknowledge and agree that staff at Bump Baby are not trained and qualified sonographers and I understand that the staff at Bump Baby are making a best judgement decision as to the gender of my baby.  With this in mind I acknowledge and accept that I have no recourse available and I waive any right to compensation should there be any error in the determination of the gender of my baby by Bump Baby.

 

Picture quality

  1. I acknowledge and understand that there are a vast array of variables that may impact the Scan and the picture quality of the Scan, as such impact the Services provided.  Some of the variables are outside of the control of Bump Baby and I understand that Bump Baby does not give any warranties or guarantees of the quality of the pictures or recordings provided as part of the Services.
  2. I acknowledge and agree that there may be instances where the gender of my baby is unable to be identified during the Scan and this may require me to book and attend another Scan.  I understand that any additional costs or refunds will be at the absolute discretion of Bump Baby.

 

Awareness and Assumption of Risk

  1. I understand that while ultrasounds are generally considered safe any Scan carries some level of risk.  In that respect, I acknowledge, accept and assume all risk of harm or injury to me or my baby for undertaking the Scan and for the provision of the Services by Bump Baby.
  2. I hereby release Bump Baby and its employees officers or agents in respect of any claim, loss, cost, damage or expense (Claim) arising out of any act to omission of Bump Baby or its employees, officers or agents unless that Claim is a direct result of negligence on behalf of Bump Baby or its employees, officers or agents.
  3. I agree that to the maximum extent permitted by law any liability for a Claim under this agreement against Bump Baby will be limited at Bump Baby’s absolute discretion:
  4. To reimbursing you the cost paid by me to Bump Baby in consideration for the Scan and any Services; or
  5. offering to re-do the Scan and provide the Services to you at no additional cost.

 

No warranties

  1. Bump Baby makes no warranties as to the quality or sufficiency of the Services provided. 

 

General

  1. This Agreement is governed by the laws in force in New South Wales and the parties agree to submit to the non-exclusive jurisdiction of the courts of that State.
  2. If any provision of this Agreement is or becomes illegal, unenforceable void or invalid, it is to be treated as being severed from this Agreement, but the rest of this Agreement will not be affected.
